Writ petition against dissolvement of the parliament being heard today in Constitutional Court

All the writ petitions against the dissolution of the House of Representatives are being heard in the Constitutional Court today.

Last Wednesday, a single bench of Chief Justice Cholendra Shamsher Jabra had directed to send all the writ petitions to the Constitutional Court.

On the recommendation of Prime Minister KP Sharma Oli, President Vidyadevi Bhandari dissolved the parliament on December 20 and announcing the date of the election in two phases on April  30 and May 10 .

Thirteen writ petitions have been filed in the Supreme Court against the President and the Prime Minister for dissolving the parliament against the provisions of the constitution.

The government has considered Articles 76 and 85 of the constitution as the basis for dissolving the parliament.

Chief Justice Jabra had on Wednesday ordered that the writ petitions be sent to the Constitutional Court as further constitutional interpretation of the section was required. The writ petitioner and the advocates had demanded a hearing in the plenary session.

Dev Gurung, leader of the CPN-Prachanda-Madhav group, senior advocates Dinesh Tripathi, Santosh Bhandari, Kanchan Krishna Neupane, Lokendra Bahadur Oli, Samrit Kharel, Gyanendra Raj Aran, Shalikram Sapkota, Kamal Khatri, Maniram Upadhyay and Amita Gautam Poudel were among those who filed the writ petition alleging that the dissolution of the parliament was unconstitutional.
