No law can be made to give death penalty to rapist in Nepal
Minister for Law, Justice and Parliamentary Affairs Dr. Shivamaya Tumbahangphe has said that it is not possible to make a law in Nepal to give death penalty to rapists and it would be against the constitution.
Responding to questions raised by lawmakers under her ministry in the House of Representatives on Monday, she said Nepal's constitution prohibits the death penalty.
She said the demands of the victims would be addressed in accordance with the constitution, the Comprehensive Peace Agreement and the Supreme Court's directive, universal recognition of human rights and humanitarian law, and the principles of transitional justice.
Stating that the government is committed to the implementation of fundamental rights, she informed that 16 acts related to fundamental rights have been drafted, out of which it is not necessary to make rules for two and the rules of two are in the process of being made.
Stating that the Ministry of Law has agreed to give the right to vote to Nepalese living abroad, Minister Tumbahangphe said that the Ministry of Law would provide assistance and facilitation in case of seeking consensus for amending the law.
In the meeting, Minister for Women, Children and Senior Citizens Parbat Gurung said that even if the budget was limited in the social sector due to COVID-19, a project of national pride could be organized in that sector.
A budget of Rs. 1.14 billion has been allocated for the Ministry of Women's Affairs. He said that the aim is to formulate a national strategy for the development of street children.
Stating that the budget has emphasized on women's enterprise program with the objective of empowering women financially, Minister Gurung said that there is a plan to amend the laws aimed at ending violence against women.
